02/27/2018 Council Preview – Land Use Appeal

We start the evening with an update on Sunnyvale’s minimum wage efforts.  This is followed by a study session to discuss the ongoing wage theft study issue.

The general session starts with three special orders. The first is for recognition of heroic action (I have no more details than that – most likely either recognition of something of particular note lately or our annual recognition of extraordinary  public safety service). The second recognizes February as National African American History Month. Finally, we recognize Arbor Day.

The consent calendar is pretty small – a purchase order for equipment required for our new co-location facility, a budget modification to pay for a solid waste study issue, and the second reading of our ADU ordinance from our last meeting.

Item 2 is the evening’s big item – a request for review of a Planning Commission decision regarding a proposed development on Azure. The Planning Commission approved construction of four new single-family houses on a large lot, but two councilmembers requested the decision to be reviewed by the full council.  Under our updated rules for PC review, councilmembers need not provide a reason for the request for review.

Item 3 is a contract amendment to modify the Environmental Impact report for the Mary Overpass. This is a bit interesting. Originally, Council approved preparing an EIR that studied five options equally, with none of them being “preferred”. At that time, staff indicated that the California Environmental Quality Act didn’t appear to prohibit such an approach to an item like this.  But in November of last year, an appeals court specifically rejected a multi-project EIR like Council approved.  So obviously, staff recommends modifying the contract to take the more traditional approach of a “preferred” option.

Item 4 is the public hearing necessary for the City to vacate portions of Carl Road, Borregas, and Crossman. We previously approved a resolution declaring our intent to do this, and this is the next step.

And item 5 amends the City’s salary table to create an Assistant Director of Community Development position.
